What is commercial lease forfeiture?

Forfeiture & peaceable re-entry — explained

If you’re a commercial landlord, solicitor or enforcement agent, here’s exactly where AHLP fits in the process.

What forfeiture is

Commercial lease forfeiture

Forfeiture is the legal mechanism by which a commercial landlord terminates a tenancy and repossesses the property following a breach — most commonly non-payment of rent. It allows the landlord to avoid lengthy court proceedings in qualifying circumstances.

How it’s carried out

Peaceable re-entry

The physical act of forfeiture is called peaceable re-entry. The enforcement agent and locksmith attend the premises outside business hours, when the property is unoccupied. The locksmith gains access, all exterior locks are changed, and possession notices are displayed.

AHLP’s role

The locksmith element

We gain entry to the premises using non-destructive techniques wherever possible, change all exterior locks, secure the property against re-entry, and document everything photographically. We hand new keys directly to the landlord or enforcement agent. That’s our role — nothing more.

On the day of forfeiture

What AHLP do at peaceable re-entry

Step by step — our role from arrival to handover of keys.

01

Arrive with the enforcement agent

We coordinate timing with the certificated enforcement agent and arrive together at the agreed time — typically outside business hours to ensure the premises are unoccupied.

02

Confirm property is unoccupied

We only proceed with entry once the enforcement agent confirms the premises are vacant and the action can proceed lawfully. If anyone is present who objects, the action stops.

03

Gain entry

We gain entry using professional non-destructive techniques wherever possible, preserving the integrity of the door and frame and avoiding unnecessary damage to the landlord’s property.

04

Change all exterior locks

All exterior locks are changed — front entrance, rear access, any side gates or shutter mechanisms. We carry a range of commercial lock types on the van. New keys are handed directly to the landlord or their agent.

05

Secure the premises

We confirm all access points are secure before leaving. Where a door or mechanism is damaged or inadequate, we advise on temporary and permanent security options.

06

Document & provide evidence

We provide photographic documentation of the lock change and the condition of access points at the time of entry. This forms part of the evidentiary record alongside the enforcement agent’s own documentation.

Who we work with

Three audiences for this service

Forfeiture jobs typically originate from one of three sources. All three can instruct AHLP directly.

Commercial landlords

If you have already confirmed you have the legal right to forfeit and have instructed or identified a certificated enforcement agent to lead the action, we can provide the locksmith element. Call us to discuss the premises and agree timing with your enforcement agent.

Solicitors & legal professionals

We work directly with commercial property solicitors advising landlord clients on forfeiture. We can be instructed to attend alongside your recommended enforcement agent, or added to a panel for Bristol-area forfeiture actions requiring a local locksmith.

Enforcement agencies

If you are a certificated enforcement agency operating in Bristol or South Gloucestershire and need a reliable local locksmith for forfeiture actions, we can be added to your approved panel. Call 07700 100146 to discuss.

Commercial forfeiture locksmith FAQs

Questions we receive from landlords, solicitors and enforcement agencies about our forfeiture locksmith service.

Commercial lease forfeiture is the legal mechanism by which a commercial landlord terminates a tenancy and repossesses the property following a breach by the tenant — most commonly non-payment of rent. It is carried out through peaceable re-entry, typically outside business hours, using a locksmith to gain access and change the locks. It requires a valid forfeiture clause in the lease and, for most breaches other than rent arrears, a prior Section 146 notice. For legal advice on whether forfeiture is appropriate, consult a solicitor specialising in commercial property.
The locksmith gains entry to the premises at the time of forfeiture — using non-destructive techniques wherever possible — then changes all exterior locks to prevent the former tenant from re-entering. AHLP attend alongside the certificated enforcement agent, document the condition of the access points and the lock change photographically, and hand new keys directly to the landlord or their representative.
Yes — always. AHLP only attend forfeiture jobs alongside a certificated enforcement agent. We do not conduct or advise on the legal forfeiture itself. Landlords should instruct a certificated enforcement agency to lead the process; we provide the locksmith element of that action. We can coordinate directly with your enforcement agent on timing and access.

AHLP are available 24/7 and can coordinate with your enforcement agent on timing to ensure we are on site at the right moment.
Lock changes at commercial forfeiture typically start from £150 for a single access point, including parts and photographic documentation. Multi-access premises are quoted individually. We always confirm a fixed price before attending. Direct invoicing to landlords, solicitors or enforcement agencies is available.

An abortive visit fee of £80 applies if Sam attends but entry cannot proceed — for example because the premises are occupied or someone present opposes the action and the enforcement agent directs that the attempt be abandoned. There is no charge if the job is cancelled before Sam leaves for the premises.
